Ok … we have heard a lot about the desperate need for Judicial Reform in South Carolina (HERE) … and the fact that South Carolina is one of only two states where our Legislature (124 House Members & 46 Senators = 170 lawmakers) elects our judges.
And the legislators electing those judges include LAWYER LEGISLATORS … the same lawyer legislators that appear before these judges they elected.
Legislator Conflicts Of Interest: So if you needed a lawyer … who would you hire? The smartest lawyer on the street … or the lawyer legislator that ELECTED the judge you will appear in front of? And if you were a lawyer legislator … wouldn’t your lawyer billable rate INCREASE substantially if you could tell clients you know the judge personally and helped put them on the bench? Yes … they are PROFITTING … SUBSTANTIALLY!!!
Judicial Merit Selection Commission (JMSC): So how does this whole process work? How do legislators maintain tight control on the process? It all runs through and is managed by legislators via the JMSC. The JMSC has 10 members … 6 members of which are legislators … so who do you think controls the process? Yes, it is simple math.
And wouldn’t a simple improvement be to bar “Lawyer Legislators” from being members of the JMSC? Put non-lawyers on the JMSC. That would be easy right? Well … they don’t want to do even that.

This is where you can find a treasure trove of information about how the process works, how to file complaints, general information … and the 2024 Judicial Elections information (which is heating up at the SC State House right now).
So today you have a Homework Assignment! Read up on the JMSC. We have to know how it works if we want to fix it … or at least if we want to know how the “game” is played (to the disadvantage of citizens).
