Who Can Arrest Your County Sheriff in SC?
Local elections matter … even coroner
We generally understand that our local County Sheriff is the highest law enforcement officer in the applicable county. They are elected officials … not municipal employees like a local City Police Chief … they basically don’t report to anyone except the voters every four years … and we understand they have the power to say “NO” to Federal authorities like the FBI, DEA, ATF, etc., etc.
Yes, a lot of folks place a lot of faith in their local elected County Sheriff to stand up and protect them from government overreach … whether that faith is well placed or not.
But what happens if your County Sheriff goes rogue? Other than the voters every 4 years, who else has any authority over your elected County Sheriff?
Well … it is a little known, perhaps weird law, following practices of Old England … but it is on the books here in South Carolina … and it empowers your local County Coroner (another elected official) to arrest your County Sheriff.

SC CODE SECTION 23-15-120: Coroner to serve or execute process on sheriff in certain circumstances.
If the sheriff shall be a party plaintiff or defendant in any judicial process, execution, warrant, summons or notice to be served or executed within his county, the coroner shall serve or execute such process, execution, warrant, summons or notice. In the discharge of such duties he shall incur such liabilities as would by law attach to their performance by the sheriff himself.
Now, if you read the above it may be a bit confusing in the legal ease … but it is basically stating that the coroner can serve a warrant and arrest the sheriff. The law itself dates back to 1839, long before the formation of SLED (State Law Enforcement Division) or the SC Highway Patrol … both of which have statewide jurisdiction … so there is still some legal interpretations which must be had by our SC Courts to say definitively or not if anyone else can “arrest” a county sheriff.
However, it is clear your County Coroner can arrest your County Sheriff.
Would your local Coroner arrest your local Sheriff if the situation required? Elections are coming up in 2024 … Sheriff’s seem to be getting into more and more legal troubles all the time … and your local coroner may be on the ballot this year. You might want to ask them. 😉

We all know about the Drew McKissick shenanigans at the SCGOP State Convention back on May 3rd, 2025 with the “sneak attack” on the Pickens County Republican Party (PCRP) and the ultimate failure to seat the 24 (anti-DREW) PCRP State Delegates on fabricated charges. It really is dumbfounding … but in reality just another example in a long line of examples since the MAGA America First insurgency began in ReOrg 2021 with the outright fraud in Greenville (HERE & HERE).
Well, it is ongoing with the SCGOP … as they say, the gift that keeps giving insofar as exposing the hypocrisy and outright corruption withing the SCGOP State Leadership & State Executive Committee itself.
Specifically – the SCGOP State Executive Committee voted ( 32 to 18 ) at its quarterly meeting on June 7th, 2025, that the Pickens County Republican Party would be “suspended” until the next quarterly meeting in September. The PCRP elected leadership can no longer use the PCRP name, website, email system, bank account … even with important elections coming up in November … and the PCRP can’t meet … but somehow (even though they can’t meet?) they are supposed to come up with a “plan” to present to the SCGOP State Executive Committee in September on how to fix the fabricated problem.
Basically Pickens was “unorganized” on June 7th (without notice) – even though the SCGOP State Executive Committee did not have the 75% of the votes needed to unorganize PCRP under the “new” Rule 16(b) which was ramrodded through in a special called SCGOP convention in July 30th, 2022.
The good news is the former PCRP Chair, Bob Fetterly (who did not run, nor had he planned to run, for re-election in 2025) has published a video response to the SCGOP charges that he arbitrarily capped the number of county delegates to 400 – a bizarre charge by the SCGOP. Bob did a great job laying out the details … and it now appears that “if” there were any “Rules Violations” … it was really the SCGOP itself that violated it’s own Rules.

The opposition hates it so much … and we temporarily had to move it to a local DENNY’S restaurant … because they actually filed a ZONING / Business Use violation as we were not authorized to have public meetings inside our HQ (outside is OK) as we are just formally permitted as a “business office” AND a PODCAST STUDIO!!! Yes, we are formally permitted at our HQ as a PodCast Studio … so guess what we can do!!!
We are now LIVESTREAMING the meeting not just for our local Greenville Friends … but also statewide (and worldwide as we have had members watch from Europe & even from a transatlantic cruise).
